Terms and Conditions

This English version is provided for reference purposes only.
In the event of any discrepancy or inconsistency, the Vietnamese version shall prevail and be legally binding.

1. General Introduction

These Terms and Conditions (hereinafter referred to as the “Agreement”) govern the legal relationship between the Customer and the Website Operator in connection with the Customer’s access to, purchase of, and use of printed photographic products offered on the Website.

By placing an order or continuing to use the Website, the Customer is deemed to have read, understood, and agreed to be bound by the entirety of this Agreement.

2. Definitions

For the purposes of this Agreement, the following terms shall have the meanings set forth below:

Website: The online platform operated and managed by the Website Operator for the display, sale, and provision of photo printing services.
Images: Photographic or visual works, including photography and fine art images, displayed or offered for sale on the Website.
Prints: Physical printed products produced from the Images, according to the size, material, and options selected by the Customer.
Copies: Any form of reproduction or duplication, whether direct or indirect, in whole or in part, of the Images or the Prints.
Customer: Any individual or legal entity purchasing Prints through the Website.
Website Operator: The lawful owner of the Website and/or the entity holding the lawful right to commercially exploit the Images offered for sale.

3. Scope of Services

The Website provides the following services:

Display and presentation of photographic and fine art works;
Enabling Customers to order Prints based on available options;
Production, printing, and delivery of Prints to the address provided by the Customer;
Customer support related to orders and products.

The Website does not grant any right to use the Images in digital file format unless otherwise agreed in writing.

The Website reserves the right to refuse or terminate the provision of services to any Customer who violates this Agreement or applicable laws.

4. Intellectual Property and Personal Rights

4.1. All Images offered for sale on the Website are the intellectual property of their respective authors and/or the individuals or organizations holding the relevant rights, and are protected under Vietnamese law.

4.2. The purchase of Prints does not constitute any transfer of copyright, reproduction rights, distribution rights, modification rights, or any other commercial usage rights in respect of the Images or Copies.

4.3. The Customer is granted ownership of the physical Prints only, strictly for personal, non-commercial display purposes.

4.4. Any act of copying, digitizing, reproducing, reselling, or otherwise commercially exploiting the Images in any form is strictly prohibited without the prior written consent of the Website Operator.

4.5. Any individuals or organizations appearing in the Images (if any) are captured in real-life contexts or public spaces. The Images are not staged and are not intended to depict, promote, or adversely affect the honor, dignity, reputation, or credibility of any individual or organization.

4.6. Neither the Website nor the author transfers to the Customer any rights relating to personal image rights, likeness, or identifiable attributes of any subjects appearing in the Images.

5. Pricing and Payment

5.1. Prices of Prints are publicly listed on the Website and may be adjusted from time to time.

5.2. Listed prices include standard printing costs but exclude shipping fees (if any), unless otherwise stated.

5.3. Customers shall make payment using the payment methods available on the Website at the time of order.

5.4. Orders shall be processed only after successful payment confirmation.

6. Production, Delivery, and Risk Allocation

6.1. Prints are produced on a made-to-order basis for each individual order.

6.2. Color variation and technical imperfections:

Printed colors may not perfectly match the colors displayed on the Customer’s electronic devices.
Slight color variations may occur between different print runs performed at different times.
Due to the inherent nature of the equipment and manufacturing technology, magnetic photo products may exhibit minor imperfections on the edges or the back side.

6.3. Delivery times are estimates only and may vary due to external factors such as weather conditions, shipping providers, or force majeure events.

6.4. All risks of loss or damage to the products shall transfer to the Customer upon receipt of the goods by the Customer or their authorized recipient.

7. Return and Refund Policy

7.1. As Prints are customized and produced upon request, the Website does not accept returns or refunds in cases where the Customer changes their mind.

7.2. The Website will only support replacement or reprinting in the following cases:

Major technical printing defects;
Damage resulting from defective packaging or carriage.

7.3. Any complaint must be submitted within 48 hours from the time of receipt, accompanied by photographic evidence of the product’s condition.

8. Customer Responsibilities

The Customer undertakes to:

8.1. Provide accurate and complete order information;

8.2. Carefully review printing options prior to order confirmation;

8.3. Not use the Images, Prints, or Copies for:

Advertising, marketing, and commercial communications;
Illustrating content of a political, religious, or legal nature, or matters of social controversy;
Usage in a manner that may misrepresent the views, statements, or identity of individuals or entities depicted in the Images;
Purposes that are unlawful, contrary to public order and good morals, or in violation of third-party rights.

9. Limitation of Liability

9.1. The Website shall not be liable for any indirect, consequential, or incidental damages, including loss of data, profits, or business opportunities.

9.2. The Website is released from liability for any claims, disputes, or damages arising from the Customer’s use of the Images, Prints, or Copies in violation of this Agreement.

9.3. The maximum liability of the Website (if any) shall not exceed the total value of the order paid by the Customer.

10. Force Majeure

The Website shall not be liable for any delay or failure to perform its obligations due to force majeure events, including but not limited to natural disasters, fires, wars, epidemics, large-scale system failures, or decisions of competent state authorities.

11. Governing Law and Dispute Resolution

11.1. This Agreement shall be governed by and construed in accordance with the laws of the Socialist Republic of Vietnam.

11.2. Any disputes arising from this Agreement shall first be resolved through good-faith negotiation.

11.3. If no resolution is reached, the dispute shall be submitted to the competent courts of Vietnam.

12. Effectiveness

In the event that one or more provisions of this Agreement are declared invalid or unenforceable, the remaining provisions shall remain in full force and effect.

This Agreement shall take effect from the date it is published on the Website and may be amended or updated without prior notice. Any updated version shall take effect immediately upon publication.

By placing an order, the Customer confirms that they have read, understood, and agreed to be bound by this Agreement.
